Stephen McDaniel Waives Hearing on Child-Porn Charges

Court officials canceled a commitment hearing scheduled for Friday on the child-exploitation charges against murder suspect Stephen McDaniel.

Police say the charges of sexual exploitation of a child stem from the discovery of pornography in McDaniel's apartment. Arrest warrants state that photos of underage children having sex with adults were recovered from a flash drive. 

McDaniel is in the Bibb County Law Enforcement Center. He's charged with murder in the death of recent Mercer University law school graduate Lauren Giddings.

District Attorney Greg Winters said McDaniel's attorney Floyd Buford waived McDaniel's right to a commitment hearing on child- exploitation charges because Buford doesn't think it would be helpful at this time.

Winters said his office will decide later whether to take the charges to a grand jury for possible indictment.

After a commitment hearing last month, a magistrate judge bound McDaniel over to a grand jury on a murder charge in the Giddings case.

McDaniel, also a recent Mercer recent law school graduate, lived in the apartment next door to Giddings. He became a person of interest in her death soon after Giddings' torso was discovered in a trash bin at the apartment complex on June 30. 

The next day, McDaniel was charged with two counts of felony burglary. He was accused of entering other apartments without permission.

McDaniel was in jail on the burglary charges when authorities charged him on August 2 with the Giddings murder.

Winters hasn't set a date for presenting the murder and burglary charges to a grand jury for consideration. He said officials are still waiting for the results of tests the FBI is conducting on evidence gathered in the case.
