OUR TOP STORY TONIGHT - ESCAPED DODGE COUNTY MURDERER PHIL MINCEY WAS RECAPTURED IN BLECKLEY COUNTY THIS EVENING.
THAT'S ACCORDING TO CAPTAIN TONY WINBORN WITH THE DODGE COUNTY SHERIFF'S OFFICE.
WINBORN SAYS HIS OFFICE WAS NOTIFIED OF MINCEY'S CAPTURE... BUT HE HAD NO DETAILS ON WHEN OR WHERE MINCEY WAS ARRESTED.
A DISPATCHER WITH THE BLECKLEY COUNTY SHERIFF'S OFFICE SAID THEY HAD NO INFORMATION ON MINCEY'S RECAPTURE.
COURT RECORDS SHOW MINCEY WAS SENTENSED TO LIFE IN PRISON IN AUGUST OF 1985 FOR THE SHOOTING DEATH OF MARY ANN HARRIS IN DODGE COUNTY.
ACCORDING TO THE DOCUMENTS.... THAT MURDER HAPPENED JUST WEEKS AFTER MINCEY WAS RELEASED FROM JAIL AFTER SERVING THREE YEARS FOR ESCAPING THE DODGE COUNTY JAIL IN 1980.

PAYNE CITY COUNCIL TONIGHT REJECTED A PLAN TO BRING A BIOMEDICAL WASTE TREATMENT PLANT TO THE AREA.
COUNCIL MEMBERS VOTED THREE TO ONE TONIGHT NOT TO ALLOW MED SAFE L-L-C TO BUILD THE FACILITY NEXT DOOR TO FREEDOM PARK.
ABOUT A DOZEN PEOPLE ATTENDED THE MEETING.
A DOCUMENT SUBMITTED BY MAYOR GRACE MC-CRIMMONS SAYS THE CITY FOUND THAT THE FACILITY WOULD USE UNTESTED TECHNOLOGY WITH NO EMERGENCY PLAN FOR SPILLS OR ACCIDENTS.
THE DOCUMENT ALSO SAYS THE FACILITY WOULDN'T FIT IN SO CLOSE TO A RESIDENTIAL AREA AND A PUBLIC PARK.
THE CITY ALSO ARGUED THE INFRASTRUCTURE WOULDN'T SUPPORT HEAVY TRUCK TRAFFIC.
KATHY MURPHY SAYS THE PLANT WOULD HAVE GONE UP ACROSS THE STREET FROM HER CLAY STUDIO.
"As a property owner I'm worried about, you know, the value of my property if something unsafe goes in across the street. Also my business as well, will students want to come there, will children want to come there."
MED SAFE L-L-C OWNER KEN TAYLOR SAYS THE TECHNOLOGY IS SAFE AND WOULDN'T POLLUTE AIR OR GROUND WATER.
HE SAYS HE FOLLOWED ALL OF THE ENVIRONMENTAL PROTECTION DIVISION'S GUIDELINES WHILE LAYING OUT PLANS FOR THE FACILITY.
TAYLOR WOULDN'T COMMENT ON TONIGHT'S DECISION UNTIL HE TALKS TO HIS ATTORNEY ABOUT WHAT TO DO NEXT.

G-B-I RECORDS SHOW THAT LAST YEAR MOST OF THE EAST DUBLIN POLICE DEPARTMENT ... INCLUDING THE CHIEF... DID NOT HAVE THE POWER TO MAKE ARRESTS..
THAT INFORMATION CAME OUT IN A G-B-I INVESTIGATION AFTER OFFICER JEFFREY DEAL SHOT AND KILLED 33-YEAR-OLD MELVIN WILLIAMS AT A TRAFFIC STOP LAST MAY.
KENNETH GLASGOW... WHO REPRESENTS WILLIAMS' FAMILY... RELEASED SEVERAL DOCUMENTS IN THE CASE...INCLUDING AN EMAIL WHERE DUBLIN DISTRICT ATTORNEY CRAIG FRASER ASKED FOR THE CASE TO BE RE-OPENED.
ACCORDING TO ANOTHER DOCUMENT... THE G-B-I'S INVESTIGATION SHOWS DEAL DID NOT COMPLETE THE REQUIRED USE OF DEADLY FORCE TRAINING IN 2009... AND LOST HIS ARREST POWERS NEARLY FIVE MONTHS BEFORE THE SHOOTING.
LAST WEEK... WILLIAMS' SISTER FILED AN APPLICATION FOR A CRIMINAL WARRANT AGAINST DEAL.
SHE WROTE THAT...AT THE TIME HE SHOT WILLIAMS...DEAL DIDN'T HAVE HIS POWER OF ARREST. SHE WROTE.....QUOTE....THIS IS FALSE IMPRISONMENT BECAUSE JEFFREY DEAL SHOT MELVIN WITHOUT LEGAL AUTHORITY TO DO SO AS AN OFFICER.
THE FAMILY'S ATTORNEY... MARIO WILLIAMS... SAYS A LAURENS COUNTY MAGISTRATE JUDGE WILL HOLD A PROBABLE CAUSE HEARING TOMORROW ON WHETHER TO ISSUE A WARRANT AGAINST OFFICER DEAL.

A MACON MAN CONVICTED OF KILLING ANOTHER TEENAGER IN A 2010 GUNFIGHT IN THE VILLAGE GREEN NEIGHBORHOOD RECEIVED A LIFE SENTENCE TODAY.
JUDGE MARTHA CHRISTIAN SENTENCED 19-YEAR-OLD SHAWN KITCHENS FOR FELONY MURDER AND AND AN ADDITIONAL10 YEARS FOR AGGRAVATED ASSAULT.
KITCHENS WAS CONVICTED LAST FRIDAY IN THE DEATH OF 17-YEAR-OLD RODRION GRAY.
THE SHOOTING HAPPENED JULY 27, 2010, DURING A GUNFIGHT SPARKED BY AN ARGUMENT AMONG SEVERAL TEENAGERS.
KITCHENS WILL BE ABLE TO ASK FOR PAROLE AFTER 30 YEARS.
A SECOND DEFENDANT IN THE CASE, TRAVIS TAYLOR, WAS SENTENCED TO 25 YEARS IN PRISON ON AGGRAVATED ASSAULT AND FIREARMS CHARGES.

SEVERAL VIEWERS RAISED QUESTIONS ABOUT OUR STORY REGARDING THE LACK OF CAMPUS POLICE DIRECTING TRAFFIC AT BIBB COUNTY ELEMENTARY SCHOOLS.
CAMPUS POLICE CHIEF DANIEL DECOURSEY SAYS A STATE LAW DESIGNED TO HELP LICENSED GUN OWNERS INADVERTENTLY TOOK AWAY CAMPUS POLICE AUTHORITY OFF SCHOOL GROUNDS..
AND HE SAYS THATS' WHY THEY NO LONGER DIRECT TRAFFIC AT BIBB'S SCHOOLS.
SO WE CONTACTED STATE SENATOR MITCH SEABAUGH.. A PRIMARY SPONSOR OF THE GUN LAW.
HE DISAGREES WITH DECOURSEY...AND SAYS GUN LAW DEALS WITH GUNS AND DANGEROUS WEAPONS.. NOT TRAFFIC OR THE POWER OF CAMPUS POLICE..
Mitch Seabaugh, State Senator: They're using this legislation as an excuse to avert what the real subject matter is because this bill, the section that we changed in there has nothing to do with police enforcement of traffic issues.
CHIEF DECOURSEY SAYS BIBB COUNTY SCHOOL BOARD ATTORNEY WARREN PLOWDEN INTERPRETED THE LAW AS MEANING CAMPUS POLICE NO LONGER HAVE JURISDICTION OFF SCHOOL PROPERTY.. DECOURSEY SAYS HE AGREES.
