GOOD EVENING AND THANKS FOR JOINING US..
I'M FRANK MALLOY... THIS IS EYEWITNESS NEWS AT 11.

TOMORROW... STEPHEN MCDANIEL IS SCHEDULED TO APPEAR IN COURT ON ALLEGATIONS THAT HE MURDERED HIS NEIGHBOR AND FELLOW MERCER LAW GRADUATE LAUREN GIDDINGS.
EARLIER THIS MONTH... POLICE CHARGED MCDANIEL WITH FELONY MURDER.
HE'S BEEN IN JAIL FOR NEARLY TWO MONTHS... STARTING WITH TWO BURGLARY CHARGES.
MACON DEFENSE ATTORNEY FRANKLIN HOGUE ISN'T INVOLVED IN THE CASE... BUT HE SAYS THREE THINGS COULD HAPPEN AT TOMORROW'S COMMITMENT HEARING.
THE JUDGE COULD DISMISS THE FELONY MURDER CHARGE AGAINST MCDANIEL... REDUCE THE CHARGE... OR RULE THAT THERE IS ENOUGH PROBABLE CAUSE... TO LET STATE TRY TO SEND THE CASE TO TRIAL.
Franklin Hogue, Criminal Defense Lawyer: "it just means,is it more likely than not that a crime has occurred and is it more likely than not that this person was involved in it?"
PROSECUTORS WILL HAVE PRESENT EVIDENCE TO PROVE THAT.
HOGUE SAYS THAT WILL GIVE MCDANIEL'S ATTORNEY HIS FIRST CHANCE TO HEAR THEIR ARGUMENTS AND ASK QUESTIONS.
THE HEARING IS SET FOR 9-30 A-M AT THE BIBB COUNTY COURTHOUSE.
WE PLAN TO CARRY IT LIVE ON OUR WEBSITE AT 13WMAZ DOT COM.

MACON POLICE ARE STILL SEARCHING FOR THE MEN WHO SHOT TWO TEENAGERS ON A STREET IN BLOOMFIELD YESTERDAY MORNING.
THE TWO WESTSIDE HIGH SCHOOL STUDENTS WERE SHOT A BLOCK AWAY FROM A SCHOOL BUS STOP. THIS WAS THE SCENE AT THAT STOP THIS MORNING... AS THE BUSES ROLLED IN.
A COUPLE OF SOUTHWEST PARENTS WAITED FOR THEIR CHILDREN TO BOARD BEFORE THEY LEFT.
MELISSA BRAXTON SAYS THE SHOOTING HAPPENED IN THE MIDDLE OF WHAT SHOULD BE HER DAUGHTER'S PATH TO THE BUS STOP.
SHE SAYS SHE DRIVES HER DAUGHTER TO SCHOOL TO AVOID PUTTING HER AT RISK.
Melissa Braxton: "It's a safety issue because of her having to leave home so early with it being dark at that time of morning by herself, the types of things that happen in this neighborhood. I mean, the crime is up, they had to put another precinct in our area."
BOTH TEENS ARE RECOVERING AT THE MEDICAL CENTER OF CENTRAL GEORGIA.

THIS AFTERNOON....AMY AUBERT AND BRITTINY BARBER SPOKE TO THE MOTHER OF HYMETHEUS JOHNSON... WHO'S IN CRITICAL BUT STABLE CONDITION.
ERIKA JOHNSON SAYS HER SON TOLD HER HE WAS WALKING WITH SHAVON BONNER TO GET A RIDE TO SCHOOL WHEN SOMEONE OPENED FIRE.
SHE THINKS IT STARTED FROM A FACEBOOK FIGHT... AND SAYS ANOTHER TEEN WAS SHOT EARLIER THIS WEEK.
WE FOUND A POLICE REPORT THAT SAID A 17-YEAR-OLD BOY WAS SHOT MONDAY IN THE BLOOMFIELD AREA.
POLICE SPOKESWOMAN.. JAMI GAUDET SAYS POLICE CAN'T CONFIRM OR DENY JOHNSON'S STORY.
IF YOU HAVE ANY INFORMATION ON THE SHOOTING... YOU CAN CALL CRIMESTOPPERS AT 1-877-68-CRIME.
AGAIN... 1-877-68-CRIME.

WARNER ROBINS POLICE ARRESTED A MAN THEY SAY IS CONNECTED TO A STRING OF ROBBERIES... INCLUDING ONE THAT CAUSED A LOCKDOWN AT NORTHSIDE MIDDLE SCHOOL THIS MORNING.
SPOKESWOMAN TABITHA PUGH SAYS 30-YEAR-OLD KIRK SOLOMON ROBBED A HOME ON HOLLY STREET AND STOLE THE OWNER'S CAR.
HE EVENTUALLY ABANDONED THAT CAR AND RAN FROM POLICE... CAUSING SCHOOL OFFICIALS TO LOCK DOWN THE MIDDLE SCHOOL AS A PRECAUTION.
SOLOMON ALSO FACESE CHARGES FOR AN ATTEMPTED ROBBERY ON AMERICAN BOULEVARD THIS MORNING... AND A ROBBERY... CAR THEFT AND KIDNAPPING ON LAKE PLACID EARLIER THIS MONTH.
PUGH SAYS POLICE MAY FILE OTHER CHARGES AGAINST SOLOMON.
SHE SAYS THEY BELIEVE HE MAY HAVE TARGETED THE ELDERLY.

BIBB COUNTY'S SPLOST IS A STEP CLOSER TO THE NOVEMBER BALLOT.
BIBB COUNTY COMMISSIONERS VOTED UNANIMOUSLY IN FAVOR OF A VOTE ON THE TAX.
IT INCLUDES THE SAME LIST OF PROJECTS MACON CITY COUNCIL APPROVED ON TUESDAY.
THE 190 MILLION DOLLAR PENNY SALES TAX WOULD PAY FOR PROJECTS INCLUDING RECREATION UPGRADES... ECONOMIC DEVELOPMENT... AND PAYING CITY AND COUNTY DEBT.
COMMISSIONER LONZY EDWARDS SAYS THE PROJECT LIST REPRESENTS THE BEST DEAL FOR THE CITY AND COUNTY.
Lonzey Edwards: "you don't get everythign you want in politics or in life. Sometimes you have to make the best deal you can and get as much as you can and certainly the projects that are in this mix will benefit this community for many many years going forward."
THE MACON-BIBB BOARD OF ELECTIONS IS SCHEDULED TO MEET TUESDAY TO VOTE ON WHETHER TO APPROVE THE SPLOST FOR THE NOVEMBER EIGHTH BALLOT.

HURRICANE WATCHES HAVE BEEN ISSUED FROM NORTH CAROLINA TO NEW JERSEY AS IRENE MOVES TOWARD THE U-S COAST.

((NATS TRAFFIC))

((NARR-1))

A mass exodus from North Carolina's Outer Banks. Thousands are fleeing Hurricane Irene -- which is expected to slam the state Saturday with 115-mile-per-hour winds.

(NAT SOT)

"YOU ARE ADVISED TO LEAVE THE AREA IMMEDIATELY."

((NARR-2))

But holdouts are staying at their own risk

((SOT)) Gov. Beverly Purdue/(D) North Carolina (:18-:21)

"This is not something to laugh at or think it's not gonna matter ."

((nats - boarding up homes))

((NARR-3))

Homeowners are boarding up their houses... And hoping they'll still be standing when they return.

((SOT)) Scott Prohoska/Homeowner (:27-:34)

"These windows here are old. With a little bit of wind, I'm sure they would not last."

((STANDUP BRIDGE)) Karen Brown, CBS News, Kill Devil Hills, NC (:35-:45 )

The Outer Banks are expected to take the brunt of Irene's first hit over the weekend. Wind damage isn't the only concern. The surge could wash away sea-level roads in neighborhoods like this one.

((NARR-4)) Wrightsville Beach, NC (:45-:50)

Beach-goers tried to squeeze in one last day of sand and surf. But it's already dangerous.

Lifeguards made about a dozen water rescues because of rip currents.

((SOT)) Timothy Michael Morrison/ Dir. of Water Search & Rescue , Kill Devil Hills (:56-1:00)

"Starting tomorrow we're going to go door to door and tell people they have to leave."

((NARR-5))

The Navy ordered more than 2 dozen ships to sea, where they'll be safer.

(MAP) The Governors of at least six states have declared states of emergency - in advance of the storm.

((SOT)) DAVID BERNARD/CBS NEWS HURRICANE CONSULTANT (1:18-1:20)

"It's gonna continue a march right up the eastern seaboard, possibly near the Jersey Shore or the NYC area. That would be a rather dramatic track, and it could cause quite a bit of disruption

((NARR-6))

Another reason officials in the Outer Banks want people out ----- they're already worried about the damage and cleanup afterward.
