I'M FRANK MALLOY....THIS IS EYEWITNESS NEWS AT 11.

THE ARREST WARRANT FOR STEPHEN MCDANIEL... LAUREN GIDDINGS' ACCUSED KILLER... SAID HE MADE STATEMENTS THAT HE COULD GET AWAY WITH MURDER.
THE 25-YEAR-OLD IS ACCUSED OF KILLING GIDDINGS.. HIS NEIGHBOR AND FORMER LAW SCHOOL CLASSMATE.. AND DISMEMBERING HER BODY.
THE WARRANT SAYS.....
MCDANIEL QUOTE HAS PREVIOUSLY COMMENTED THAT HE COULD COMMIT MURDER... AND PROVIDED DETAILS OF METHODS TO AVOID DETECTION...
WHICH ARE SIMILAR TO THE FACTS AND CIRCUMSTANCES SURROUNDING THE KILLING OF LAUREN GIDDINGS.
THE WARRANT SAYS INVESTIGATORS FOUND A HACKSAW WITH TRACES OF GIDDINGS' D-N-A IN A LOCKED STORAGE CLOSET AT THE APARTMENT COMPLEX WHERE SHE AND MCDANIEL LIVED.
INSIDE MCDANIEL'S APARTMENT... THE WARRANT SAYS INVESTIGATORS FOUND A PACKAGE FOR THE SAME-BRAND HACKSAW.
THE WARRANT ALSO SAYS MCDANIEL HAD A KEY TO GIDDINGS' APARTMENT AND A MASTER KEY TO THE COMPLEX.
ON JUNE 30TH... POLICE FOUND PART OF GIDDINGS' BODY IN A GARBAGE CAN OUTSIDE HER APARTMENT.
THE WARRANT STATES THE MURDER HAPPENED "ON OR ABOUT" JUNE 25-TH.
MCDANIEL IS BEING HELD IN THE BIBB COUNTY JAIL.
HIS ATTORNEY SAYS HIS CLIENT INSISTS HE IS INNOCENT.

POLICE WERE BACK AT GIDDINGS' BARRISTER'S HALL APARTMENT THIS AFTERNOON COLLECTING MORE EVIDENCE.
INVESTIGATORS AND CITY EMPLOYEES INVESTIGATORS REMOVED THE BATHTUB FROM GIDDINGS' APARTMENT.
LAST NIGHT 13WMAZ'S ELEANOR LISSITZYN LOOKED INSIDE GIDDINGS' FORMER APARTMENT.
SHE SAID SHE SAW A SERIES OF SCRATCHES ON THE OUTSIDE RIM OF THE BATHTUB IN GIDDINGS' BATHROOM.
TODAY THAT SIDE OF THE TUB WAS COVERED WITH CLOTH AND TAPE.
A CRIME SCENE INVESTIGATOR ON THE SCENE WOULDN'T SAY WHY THEY TOOK THE TUB... BUT SAID THEY'RE MOVING IT TO THE MACON CRIME LAB.

MACON POLICE ALSO CONTINUE TO SEARCH FOR ANSWERS... IN TWO UNSOLVED HOMICIDES FROM LAST WEEK....
THE FAMILIES OF 35-YEAR-OLD ALFRED SMITH... AND 20-YEAR-OLD ANTHONY HARRIS... SAY THEY NEED CLOSURE.
HARRIS WAS SHOT AND KILLED EARLY FRIDAY MORNING AT WHISKEY RIVER NIGHT CLUB... AND SMITH WAS GUNNED DOWN FOUR DAYS EARLIER AT WINGS CAFE.
FOR THE FAMILIES... FINDING THE PEOPLE WHO KILLED THEIR LOVED ONES WOULD MEAN A STEP FORWARD.
Lawanna Smith, Macon: "It would mean a lot. That means my son would not have died in vein. That means somebody out there cares and would like to see this person punished for what he did to my son."
POLICE SPOKESWOMAN JAMI GAUDET SAYS POLICE ARE INTERVIEWING PEOPLE... TRACING CELL PHONE RECORDS... AND GOING DOOR TO DOOR.
SHE SAYS THE ONLY UPDATE IS AN ADDED DESCRIPTION TO SOMEONE WHO POLICE SAY COULD BE INVOLVED IN THE HARRIS CASE... A5"6 MALE WITH A STOCKY BUILD... WHO GAUDET SAYS... IS NOW DESCRIBED TO HAVE A PECULIAR NOSE.

IN ELEVEN DAYS... THE CITY AND COUNTY MUST HAVE A FINAL AGREEMENT ABOUT WHAT TO PUT ON THE PROPOSED SPLOST BALLOT.
TONIGHT... CITY OFFICIALS SAY MACON'S PRIORITIES ARE IN LINE WITH THE COUNTY'S... EXCEPT ON ONE KEY TOPIC.
THE COUNTY SUGGESTED SPENDING ABOUT FORTY MILLION DOLLARS ON RECREATION.
MACON CITY OFFICIALS INITIALLY WANTED ABOUT 75 MILLION.
COUNCILWOMAN LAUREN BENEDICT SAYS SHE'S ALSO CONCERNED THAT THE COUNTY'S PRIORITY LIST DOESN'T INCLUDE RENOVATIONS OR MAINTENANCE FOR REC CENTERS WITHIN CITY LIMITS.
Lauren Benedict: "We certainly are underserved in the unincorporated area, so we know that we need more facilities there. But I'm concerned if we don't allow for maintenance of some of our current facilities then they're going to continue to deteriorate and once recreation shifts over to a county prioritity I don't want them to continue to be at the bottom of the priority list."
IF THE SPLOST PASSES... THE COUNTY HAS AGREED TO TAKE OVER THE CITY'S RECREATION DEPARTMENT.
CITY AND COUNTY OFFICIALS HAVE TO REACH AN AGREEMENT ON THE PROJECTS AND HOW MUCH TO SPEND ON EACH BY AUGUST 15.

ONE LANE OF SECOND STREET IN FRONT OF THE BIBB COUNTY COURTHOUSE IS CLOSED.
ITS PART OF A STORM WATER DRAINAGE IMPROVEMENT PROJECT IN DOWNTOWN MACON.

CREWS DUG A HOLE IN THE ROAD IN FRONT OF BIBB COUNTY COURTHOUSE TO PREPARE FOR NEW DRAINAGE PIPES.
THEY'RE MOVING PHONE COMPANY LINES AND OTHER UITILITIES OUT OF THE WAY SO THE CITY CAN INSTALL CONCRETE PIPES.
MACON CITY ENGINEER BILL CAUSEY SAYS IT'S A PROACTIVE MOVE.
"Drainage is one of those things that no one knows about 'til it fails. If we waited until these pipes failed, then the next thing is the street caves in, the street is closed, it breaks the utilities that are in there. It gets really really expensive when that happens."
THE PIPES FUNNEL STORMWATER OUT OF THE CITY INTO THE OCMULGEE.
CAUSEY SAYS THEY WERE BUILT BACK IN THE 18-HUNDREDS... AND WHILE SOME ARE HOLDING UP... OTHERS LIKE THE ONE RUNNING IN THIS ALLEY ALONG THE COURTHOUSE... HAVE STARTED TO CAVE IN.
"In some of the cases, the mortar just came out of the bricks and the bricks collapsed. Sometimes utilities would be punched through the brick, sometimes the water runs so constantly through the pipes that it eats the bottom of the pipes away and just collapses."
THE CITY IS REPLACING THE BRICK PIPES USING 5 MILLION DOLLARS FROM OF A SPECIAL PURPOSE LOCAL OPTION SALES TAX COLLECTED FROM 2003 UNTIL 2006.
CAUSEY SAYS THAT MONEY HAS ALMOST RUN OUT... AND THERE'S STILL A LOT TO DO.
"The hope is the next splost will have funds available and will be approved for more stormwater improvements in Macon and Bibb County. We both have infrastructure issues that need repair."

CAUSEY SAYS SECOND STREET AT WALNUT WILL TEMPORARILY REOPEN BY AUGUST 15.
IT WILL CLOSE AGAIN IN A FEW WEEKS WHEN CITY CREWS START INSTALLING CONCRETE PIPES UNDER THE ROADWAY.

OFFICIALS FROM MONROE AND BIBB COUNTIES SAY NEGOTIATIONS ABOUT THE DISPUTED COUNTY LINE HAVE STOPPED
THAT'S LESS THAN THREE WEEKS AFTER SECRETARY OF STATE BRIAN KEMP ENCOURAGED THE COUNTIES TO SETTLE THE ISSUE... WITHOUT HIM HANDING DOWN A RULING.
THE DEBATE STEMS FROM A SURVEY BY TERRY SCARBOROUGH IN 2008... HE SAYS ABOUT 500 ACRES SHOULD BE MOVED FROM BIBB TO MONROE COUNTY.
REPRESENTATIVES FROM BOTH SIDES SAY THEY'RE READY TO FINALLY SOLVE THE DISPUTE.
Chairman James Vaughn, Monroe County: "Before the secretary of state had made that request,we had spent substantial effort on both sides in good faith trying to work this out in a compromise manner. I think both sides believe now it's just best for him to issue a ruling.
Commissioner Elmo Richardson, Bibb County: He's not under any particular timeline to make that decision, however we would hope he would just go ahead and not keep this in limbo to long.
THE SECRETARY OF STATE HAS NOT SET A DATE FOR WHEN HE'LL MAKE HIS DECISION.
