AND I'M FRANK MALLOY..THIS IS EYEWITNESS NEWS AT SIX.

STEPHEN MCDANIEL TODAY WENT BACK TO COURT...THEN BACK TO JAIL.
NEXT WEEK...HE MAY FIND OUT WHETHER THE BIBB COUNTY D-A'S OFFICE CAN PROSECUTE HIM ON BURGLARY CHARGES.
MCDANIEL IS A FORMER NEIGHBOR OF HOMCIDE VICTIM LAUREN GIDDINGS AND POLICE NAMED HIM AS A PERSON OF INTEREST IN HER KILLING.
TODAY....HIS ATTORNEY... FLOYD BUFORD... ASKED A JUDGE TO DISQUALIFY THE BIBB COUNTY DISTRICT ATTORNEY'S OFFICE FROM MCDANIEL'S BURGLARY CASE.
CANDACE ADORKA WAS AT THAT HEARING TODAY... CANDACE WHAT HAPPENED?
THE HEARING LASTED ABOUT AN HOUR LONG...WITH BOTH LAWYERS GETTING A CHANCE TO MAKE THEIR CASE TO JUDGE TRIPP SELF.
BUFORD WAS CONCERNED MCDANIEL'S THREE MONTHS AS AN INTERN AT THE D-A'S OFFICE WOULD CREATE A CONFLICT OF INTEREST.... THAT WOULD KEEP HIS CLIENT FROM GETTING A FAIR TRIAL.
HE WAS ALSO CONCERNED ABOUT HOW THE CASE WOULD LOOK TO THE PUBLIC....AND WHETHER PEOPLE BELIEVED MCDANIEL IS BEING TREATED FAIRLY.
WINTERS ARGUED THERE ARE NO GROUNDS TO REMOVE HIS OFFICE FROM THE CASE.
HE SAID MCDANIEL DIDN'T WORK CLOSELY WITH ANYONE IN THE OFFICE DURING HIS INTERNSHIP THIS SPRING.
BUT EVEN IF HE DID.....WINTERS SAID.....HIS OFFICE CAN STILL HANDLE THE CASE WITHOUT BIAS.
WINTERS ALSO ARGUED THERE IS NO LAW SAYING A JUDGE SHOULD RULE BASED ON A PERCIEVED CONFLICT OF INTEREST -- HOW THE PUBLIC MIGHT VIEW THE CASE -- AS OPPOSED TO AN ACTUAL CONFLICT.
BUT HE ARGUES THAT'S NOT NECESSARY.
"Where do you draw the line? If it was someone that I grew up with or one of my assistants greW up with or somebody that one of my assistants went to church with, do you just remove that one person? Or in this case, he's asking our entire office, where do u draw that line?
STEPHEN'S PARENTS... GLENDA AND MARK MCDANIEL... ATTENDED THE HEARING.
HIS FATHER MARK SAT QUIETLY FOR MOST OF THE HEARING... NODDING OCCASIONALLY WHILE THE DISTRICT ATTORNEY WAS MAKING HIS CASE.
BUT HIS MOTHER... GLENDA... BECAME EMOTIONAL TOWARD THE END OF THE HEARING.
SHE STOOD UP AND ASKED THE JUDGE "MAY I SPEAK"
HER VOICE WAS CRACKING AND SHE STEADIED HERSELF ON THE BENCH IN FRONT OF HER.... AND THE JUDGE REPLIED... "NO M'AM YOU MAY NOT."
SHE SAT DOWN AND CRIED QUIETLY
FLOYD BUFORD... THEIR SON'S ATTORNEY... SAID AFTER THE HEARING THAT THE PAST FEW WEEKS HAVE BEEN AN ORDEAL FOR THE MCDANIELS.
HE SAID STEPHEN WOULD HAVE LIKE TO BE HOME WITH HIS FAMILY AND STUDYING FOR NEXT WEEK'S BAR EXAM.
FRANK... LORRA?
JUDGE SELF SAID HE WOULD TAKE SOME TIME TO REVIEW THE CASE LAW BEFORE RULING.
WINTERS SAID HE EXPECTED THE DECISION EARLY NEXT WEEK. HE SAID IF THE JUDGE ORDERS HIS OFFICE OUT OF THE CASE.... HE'D HAVE TO ASK A SPECIAL PROSECUTOR FROM A NEIGHBORING COUNTY TO HANDLE IT.

MORE THAN FOUR MONTHS HAS PASSED SINCE THE DEATHS OF WARNER ROBINS SISTERS... BRIDGETT AND LESLIE SULLIVENT.
THE TWO GIRLS DIED AFTER A CAR ACCIDENT ON HIGHWAY 96
AFTER THE COMMUNITY GRIEVED THE LOSS... THE STORY APPEARED TO BE OVER.
AS IT TURNS OUT... IT ISN'T.
IN FACT... LESLIE SULLIVENT'S DEATH CHANGED A LIFE... AND HAS THE POTENTIAL TO HELP HEAL WOUNDED SOLDIERS.

THEY OFFERED LESLIE'S HEART... KIDNEYS AND LUNGS. THEN THEY SAY... LIFELINK... MADE AN UNUSUAL REQUEST.
