WARNER ROBINS POLICE SAY A 14 YEAR OLD GIRL WAS SHOT BY HER BROTHER.
LAUREN DISPIRITO HAS BEEN FOLLOWING THIS STORY... SHE'S JOINING US NOW WITH MORE.
LORRA... LEAH... POLICE SPOKESWOMAN TABITHA PUGH SAYS IT HAPPENED AT A HOME ON CRESCENT DRIVE.
THAT'S NEAR LINDSEY ELEMENTARY SCHOOL, OFF NORTH DAVIS DRIVE.
PUGH SAYS THE GIRL WAS SHOT IN THE ARM AROUND 1:45 THIS AFTERNOON.
SHE SAYS HER 16-YEAR-OLD BROTHER RAN AWAY... BUT OFFICERS FOUND HIM ABOUT AN HOUR LATER AT A NEARBY HOME.
THEY TOLD US THEY WERE QUESTIONING HIM ....BUT HE HAS NOT BEEN CHARGED.
SO FAR POLICE HAVEN'T EXPLAINED HOW THE GIRL WAS SHOT....OR WHY.
AARON HAUCK ((hawk)) LIVES NEXT DOOR TO THE HOME WHERE THE SHOOTING HAPPENED.
HE DESCRIBED WHAT HE SAW.
Aaron Hauck, Warner Robins: " Yeah all the sirens and the police cars and all the activity brought me outside and right over there on the doorstep there's just a bunch of pools of blood just scattered down the walkway and everything out there and that's what I first noticed when I came outside was that somebody had been stabbed or shot or something."
TABITHA PUGH SAID THE GIRL IS CONSCIOUS AND ALERT AND IN STABLE CONDITION AT THE MEDICAL CENTER OF CENTRAL GEORGIA IN MACON.

A CITY OF FORSYTH MUNICIPAL COURT JUDGE RESIGNED.... AFTER A D-U-I ARREST.
THAT'S ACCORDING TO HIS LAWYER... DUSTIN (BUT-ih-gig) BUTTIGIEG.
HE SAYS JUDGE JEFF DAVIS WAS ARREST AROUND 1-15 SATURDAY MORNING..... ON HIGHWAY 87 IN NORTH BIBB COUNTY.
THE LAWYER SAYS BIBB COUNTY DEPUTIES DIDN'T GIVE DAVIS A BREATHALYZER TEST... OR FIELD SOBRIETY TEST.
HE SAYS HE WANTS TO REVIEW TAPES OF THE ARREST... AND POLICE REPORTS.... BEFORE DISCUSSING WHETHER DAVIS WAS DRINKING.
(BUT-ih-gig) BUTTIGIEG SAYS DAVIS RESIGNED BECAUSE HE DOESN'T THINK IT'S FAIR... TO RULE ON D-U-I CASES WHILE HIS OWN IS PENDING.
THE LAWYER SAYS JUDGE DAVIS WON'T BE ASKING FOR SPECIAL TREATMENT... AND WANTS HIS CASE HANDLED LIKE ANY OTHER.
HE SAYS DAVIS IS STAYING ON AS A MONROE COUNTY MAGISTRATE JUDGE... BECAUSE HE DOESN'T HANDLE D-U-I CASES IN THAT JOB.

IT NOT JUST THE CITY OF MACON ANYMORE... BIBB COUNTY IS ALSO CONSIDERING PLANS TO RESTRICT WHERE YOU CAN SMOKE.
CANDACE ADORKA ATTENDED THE COUNTY COMMISSION MEETING TODAY...
SHE REPORTS THE PRESIDENT OF MACON'S COMMUNITY HEALTH WORKS...GREG DENT... ASKED CHAIRMAN SAM HART TO BRING UP THE ISSUE IN THE COMMISSION MEETING.

THE BIBB COUNTY COMMITTEE ON ORDINANCES WILL NOW HAVE TO CONSIDER A SMOKING ORDIANNCE JUST LIKE THE ONE BEFORE THE MACON CITY COUNCIL.
BIBB COUNTY COMMISSION CHAIRMAN SAM HART SAYS HE BROUGHT UP THE ISSUE FOR THE SAKE OF LOCAL BUSINESSES.
HE WORRIES IF THE CITY PASSES SMOKING RESTRICTIONS AND THE OCUNTY DOESN'T... THOSE BARS AND RESTAURANTS IN THE CITY WILL BE AT AN UNFAIR DISADVANTAGE.
HART: "For that kind of deal that could adversely affect businesses in the city, we need at least to give that consideration in the county to see if the county comission wanted to ban smoking in public places."
COMMISSIONER JOE ALLEN CAME RIGHT OUT AND OPPOSED ANY SMOKING RESTRICTIONS. HE SAYS IT UNFAIRLY INFRINGES ON PEOPLE'S RIGHTS.
HE ALSO SAYS THE COUNTY SHOULD HAVE BEEN INVOLVED WITHT HE CITY ORDINANCE FORM THE VERY BEGINNING.
ALLEN: "We ought to be working on this together. And after they pass it they're gonna send it to us to pass it? I had a little problem with that. That's not the right hand knowing what hte left hand is doing."
COMMISSIONERS WILL DISCUSS THE SMOKING ORDINANCE AT THEIR NEXT MEETING LATER THIS MONTH... THAT'LL GIVE THEM TIME TO LOOK OVER THIS STUDY FROM THE UNIVERSITY OF GEORGIA THAT LOOKS AT HOW POEPLE IN BIBB COUNTY FEEL ABOUT SMOKING IN PUBLIC.
FOR EXAMPLE IT SAYS 80 PERCENT OF PEOPLE SURVEYED DON'T BELIEVE SMOKING SHOULD BE ALLOWED IN RESTAURANTS.

AN ARMY NATIONAL GUARD FIRST LIEUTENANT.. PAUL BRONSON QUALIFIED FOR MAYOR IN THE AFTERNOON.. A SHORT WHILE AFTER RESIGNING HIS JOB AS A MACON FIREFIGHTER.
Paul Bronson, Mayoral Candidate:I resigned today from the Bibb County Fire Department, station 106 on Thomaston and Price.Sad day but yet at the same time bitter sweet. Chief Riggins has taught me a lot of things. While at the fire department, I've had the opportuniity to work with great men.

AT LEAST TWO PEOPLE PLAN TO RUN FOR THE DISTRICT 26 STATE SENATE SEAT WHEN SENATOR ROBERT BROWN RESIGNS TO RUN FOR MACON MAYOR.
ONE OF THEM IS STATE REPRESENTATIVE DAVID LUCAS.
DURING THE TAPING OF THIS WEEK'S CLOSE UP.. HE TALKED ABOUT SEVERAL ISSUES INCLUDING THE ON-GOING PROPOSAL TO CONSOLIDATE THE CITY AND BIBB COUNTY GOVERNMENTS.
HE ALSO SAYS HIS RECENT HEART ATTACK HASN'T STALLED HIS CAMPAIGN.
David Lucas, Senate Candidate: I never stopped even when I was in the hospital. That's what my wife and them were getting on me about. I was conducting business from the hospital bed.
MACON CITY COUNCIL PRESIDENT MIRIAM PARIS SAYS SHE PLANS TO RUN FOR THE DISTRICT 26 SEAT AS WELL.
DISTRICT 26 INCLUDES PARTS OF BIBB.. HOUSTON AND WILKINSON COUNTIES.. AND ALL OF TWIGGS COUNTY.

MACON CITY COUNCIL MEMBERS TOOK A FIELD TRIP TODAY... TO LOOK AT THE CONDITIONS OF SOME OF THE CITY'S RECREATION CENTERS.
THE COMMUNITY RESOURCES AND DEVELOPMENT COMMITTEE BEGAN THE TRIP AT LIBERTY LAKE ACROSS FROM THE BALL FIELDS AT FREEDOM PARK... BEFORE CHECKING OUT THE POOLS AND WEIGHT ROOMS AT THE REC CENTER.
THE CITY AND COUNTY ARE TALKING ABOUT USING A PROPOSED SPLOST TO PAY FOR RECREATION PROJECTS.
COUNCILMAN TOM ELLINGTON SAYS COUNCIL WANTS TO SEE WHICH UPGRADES THE REC CENTERS NEED... AND WHAT THEY WOULD COST.
PARKS AND RECREATION DIRECTOR DOC DOUGHERTY SAYS HE HOPES COUNCIL MEMBERS REALIZE THE VALUE OF THE CENTERS.
Tom Ellington: "We've got some definite things that we need to take care of but the question is how much can we operating within our current budget and how much might we be able to do if we did elect to go forward with a SPLOST."
Doc Dougherty: "The one most important thing I think is that theY'RE just not throw away centers, they're not places people should avoid. ThEY'RE quality centers, theY'RE just not what we really need in 2011."

IF DODGE COUNTY KEEPS FLYING THE CONFEDERATE BATTLE FLAG NEAR THE COURTHOUSE....A LOCAL N-DOUBLE-A-C-P LEADER IS PROMISING THEY'LL BRING A BATTLE OF THEIR OWN.
ABOUT 100 PEOPLE PROTESTED THE CONFEDERATE FLAG LAST NIGHT.
CENTRAL GEORGIA CHAPTERS OF THE NAACP WANT DODGE OFFICIALS TO REMOVE THE FLAG.
DAVID BOOKER OF THE MACON CHAPTER... SENT US THIS PICTURE.
SOME SEE THE CONFEDERAL FLAG AS A PART OF SOUTHERN HISTORY.... OTHERS AS A SYMBOL OF SLAVERY.
BUT BOOKER SAYS THAT THEY WILL BE AT THE DODGE COURT HOUSE EVERY MONTH UNTIL THE FLAG IS TAKEN DOWN.
HE SAYS THE NATIONAL NAACP MAY GET INVOLVED.
