PHILLIP SINCLAIR.... OWNER OF CLUB ELEMENT... SAYS HE'S WORRIED IT WILL DRIVE CUSTOMERS OUT OF THE CITY.
"My gut reaction is because there is such a fine line between the city and the county that the smokers in the city who are no longer allowed to smoke in bars and night clubs, all they have to do is drive five miles and they're in the county."
SINCLAIR SAYS HE AND OTHER BUSINESS OWNERS PLAN TO FIGHT BACK AGAINST THE LAW.
THE SMOKING BAN IS SET TO GO IN TO AFFECT SEPTEMBER FIRST.
PEOPLE CAUGHT SMOKING ILLEGALLY COULD FACE FINES OF ONE HUNDRED TO FIVE HUNDRED DOLLARS.

THE F-A-A SAYS IT'S INVESTIGATING ANOTHER POSSIBLE CONTROLLER ERROR... THIS ONE INVOLVING A PLANE CARRYING FIRST LADY MICHELLE OBAMA.
THE PLANE LADY HAD TO ABORT LANDING YESTERDAY BECAUSE IT CAME TOO CLOSE TO ANOTHER PLANE.
TARA MERGENER HAS MORE FROM WASHINGTON.
The plane carrying First Lady Michelle Obama wasn't able to land at Andrews Air Force Base on its first try Monday. It got too close to a larger military cargo plane flying just ahead. The first lady was returning to Washington from a trip to New York .
Once The large cargo plane ....a C-17... landed -- it would not have been able to exit the runway quickly enough to allow Mrs. Obama's plane....a military version of a Boeing 737... to make a safe landing
At first , controllers tried to slow Mrs. Obama's plane down by having it do a series of turns. Then they ordered the pilot do what is called a "go around." That means to make another circle and second landing approach.
((STANDUP BRIDGE)) Tara Mergener, CBS News, Washington
A "go-around" is not uncommon or unsafe. But when the First Lady is on board the plane, it gets plenty of attention.
The Federal Aviation Administration requires a minimum separation of five miles between planes, to avoid dangerous turbulence. But a possible mistake at a regional radar facility allowed Mrs. Obama's plane to get within three miles of the larger cargo jet. ...technically too close.
The FAA released a statement saying "The Boeing 737 landed safely after executing the go around. The aircraft were never in any danger."
Now the FAA is investigating to find out why the two planes got too close in the first place .
VICE PRESIDENT BIDEN'S WIFE JILL WAS ALSO ON BOARD THE PLANE.
RETIRED HARTSFIELD-JACKSON SENIOR AIR TRAFFIC CONTROLLER GARY BRITTAIN... SAID IN SOME CASES... THE RULES WOULD HAVE ALLOWED THE TWO JETS TO FLY THAT CLOSE TOGETHER.
FAA RULES ALLOW JETS TO FLY CLOSER TOGETHER IF A PILOT CAN SEE OTHER AIRCRAFT AND AGREES TO TAKE RESPONSIBILITY FOR STAYING SEPARATED.

IF YOU'RE DOING SOME BUDGET TIGHTENING.... YOU'RE PROBABLY SITTING DOWN WITH YOUR BILLS AND LOOKING FOR WAYS TO TRIM EXPENSES.
BUT IF YOU'RE LOOKING AT THE CABLE BILL AS SOMETHING THAT NEEDS EITHER CUTTING COMPLETELY OR TAKING AS ONE UNIT... WE HAVE A FEW TIPS FOR YOU.
FOR THIS WEEK'S GEEK 13... I SAT DOWN WITH C-NET'S DAVID KATZMAIER TO TALK ABOUT SOME TIPS ON USING THE INTERNET TO CUT BACK ON YOUR CABLE PACKAGE.
HE ALSO TALKED ABOUT A FEW WARNINGS TO THINK ABOUT BEFORE YOU MAKE THE LEAP.
DK: Uh, well, the first thing you can do if you can stand to lose them is check out your premium channels. Obviously, those are going to be the most expensive in your cable bill. Get rid of the HBO and the Showtime and try to look for movies that are renting from NetFlix or some other source."
LJ: Do you think a lot of people are willing to turn off the cable completely?
DK: Uh, I think fewer people than have been reported are actually willing to do it because it's very difficult. I tried to do it myself, actually, and we only lasted a month in my household.
LJ: What about DVR recordings? A lot of people are used to being able to save their shows whenever they can. Is that something that a lot of people may consider giving up?
DK: You can save a few bucks by giving up the DVR. I personally think the DVR is so convenient and we're so addicted to it in my household that we would really rather cut corners somewhere else. Again, you can reduce your channels to their basic components; you can even call up your cable company and ask if they have a less expensive package that they're not advertising. Some guys do and they'll give you just their most basic channels, and they're required by law to do that.
LJ: A lot of stations and cable channels are featuring their episodes online. Is that something that people can take advantage of?
DK: Yes, one of the growing ways to use the Internet is to watch TV shows and movies. NetFlix is kind of the largest supplier right now. There's also a service called Hulu Plus. Both of those cost $7.99/month and up for subscription. You get basically unlimited video. The downside is, you often don't have access to the shows that you want, the show access is hit and miss depending on the network, and of course you don't usually get immediate access to the shows on the night that they air, so if you're the kind of person that wants to have the watercooler conversation the next day, you're probably better off using cable again for your tv.
LJ: So you think that's just a sacrifice that people are going to have to make, either be up on their shows or save some money for the household.
DK: Well again, you can make some sacrifices as long as you're willing to look at the shows a little bit later or maybe watch a little bit less TV. People who are really into sports have a hard time cutting cable because again cable is kind of the only place to get most sports broadcasts."
